Notification
New Delhi, the 25th September 2002.
GSR 666 (E).- In exercise of the powers conferred by section 83 of the Standards of Weights and Measures Act, 1976 (60 of 1976) , the Central Government hereby makes the following rules further to amend the Standards of Weights and Measures (Packaged Commodities) Rules, 1977, namely:-
1. (1) These rules may be called the Standards of Weights and Measures (Packaged Commodities) Third Amendment Rules, 2002.
(2) They shall come into force on the expiry of one hundred and eighty days from the date of their publication in the Official Gazette.
2. In the Standards of Weights and Measures (Packaged Commodities) Rules,
1977, (herein after referred to as the ‘said rules’) in rule 6, in sub-rule (1), -
(i) in clause (d), the following proviso shall be inserted, namely:
“ Provided that for packages containing food articles, the provisions of the Prevention of Food Adulteration Act 1954 (37 of 1954) and the rules made there under shall apply.”;
(ii) in proviso (A), clauses (i) to (v) shall be omitted;
(iii) in proviso (B), the following shall be inserted, namely:-
“Provided that the said provision shall not apply to the packages containing food products, where the “Best before or Use before” period is ninety days or less from the date of manufacture or packing.”
(iv) in proviso (C), clauses (i), (ii),(iv), (v) and (vi) shall be omitted.
(3) In the said rules, in sub-rule (4) of rule 12, in second column of Illustration, against item (e), for the existing entries, the following entries shall be substituted, namely:-
“ As provided in the relevant Bureau of Indian Standards specification”.
